Riyueguang announced yesterday that the German Federal Monopoly Office has approved ASE's acquisition of the disputed product without any conditions. This marks the second country after South Korea to grant approval for the purchase of counterfeit goods by ASE. The decision came as a significant development in the ongoing legal and regulatory process surrounding the acquisition.
Following the approvals from South Korea and Germany, market observers are now closely watching the stance of Taiwan Fair and the Chinese Ministry of Commerce. Industry experts believe that these two entities will play a crucial role in determining the success of the ASE project moving forward.
According to Riyueguang, the German representative received the official approval letter from the Federal Monopoly Office. The company’s application focused on increasing its stake and control over the products, which did not trigger any provisions under the German Competition Act (GEB) 36. As a result, the case was cleared for implementation.
After the announcement of the second public bid for the counterfeit goods, ASE quickly submitted applications for regulatory approval in multiple jurisdictions. In addition to seeking clearance from the Taiwan Fair, the company also filed requests with authorities in South Korea, Germany, and mainland China.
With the Chinese Lunar New Year holiday approaching this weekend, it is expected that both China and Taiwan will complete their reviews before the holiday period. To accommodate the extended timeline, ASE has decided to extend the public acquisition period, pushing the deadline from one month to mid-March.
On the stock market, shares of the company closed lower on Friday, influenced by concerns over Apple's first-quarter supply chain orders. Foreign investors took a cautious approach, leading to a sell-off of over 3,683 shares. The stock ended the day down 2.39%, closing at 34.65 yuan.
