Energy Bureau Formulates 12 Regulations on Power Energy Supervision

After the revocation of the SERC, the newly formed National Energy Administration is trying to rebuild the regulatory framework to make up for the vacuum of energy regulation.

According to the "three-determined" plan, the National Energy Administration has already formulated the "12" regulation of the energy market in order to improve energy supervision and management, promote the construction of the energy market, and maintain the order of the energy market.

Compared with the weak regulatory framework in the age of SERC, the space for supervision of the Energy Administration after the institutional reform has greatly expanded. Under the circumstance that the "renewable energy power generation full-scale acquisition guarantee" regulations have been idling and difficult to implement for many years, the Energy Administration has proposed strengthening the monitoring of grid-connected electricity generation from renewable energy sources and coordinating the resolution of abandoned wind, abandoned light, abandoned water, etc. problem.

In addition, supervision of the power grid sector, which is difficult to implement in the era of the SERC, will also be strengthened. The performance of regulatory expansion is: deepening the supervision of power dispatching, the transmission and distribution cost of power grids and price supervision, conducting the analysis of the investment performance of typical power grid projects (including UHV), and reviewing and adjusting some trans-regional transmission prices.

In accordance with the regulatory arrangements, the Energy Administration will verify the transmission prices of transboundary projects sent from Shaanxi Province, Shanxi Province, and the Three Gorges Project that have been in operation for many years, and put forward price adjustment opinions.

In addition to the traditional power supervision, the Energy Administration will expand the scope of supervision and increase the supervision of oil and gas and coal fields. Study and formulate the "Measures for Fair and Open Supervision of Oil and Gas Pipeline Network Facilities", select some areas to carry out pilots for the cost analysis of oil and gas pipeline network operations, organize and carry out special supervision research on the performance rate of coal contracts, standardize transactions, and protect the legitimate rights and interests of market participants.

Zhou Dadi, former director of the Energy Development Bureau of the National Development and Reform Commission, said that in the past, due to lack of reforms, there was not much content to be incorporated into market supervision. What needs to be clarified now is "strengthen security and quality supervision rather than the specific production process; supervise unfair market competition, and monitor real-time problems in the market in real time rather than supervision."

In view of the above-mentioned “Twelve” regulation of the market, experts from the Energy Policy Research Center of the China Energy Research Institute believe that after the restructuring of the Energy Administration, the power of matching the responsibilities of the Energy Administration has not been substantially enhanced. In particular, the cost and price functions are still in the National Development and Reform Commission, and the Energy Bureau only has the right to propose and the supervision is relatively difficult.

The existing national energy regulatory function is fragmented - the cost of the tube cannot be controlled, the cost of the tube cannot be controlled by investment and services, and the tube market cannot control the price. Therefore, it is not easy to improve the regulatory pattern of the energy market.
